Your use of this site, following any such modification, constitutes your agreement to be bound by the Terms of Use, as last modified. You may use this website for lawful purposes only. You may not use this website for any purpose that is prohibited by any state or federal law or regulation or to facilitate the violation of any applicable law or regulation.

PawPointer has taken commercially reasonable steps to investigate any recommended breeder posted to this website by way of telephonic interview with the breeder and visitation and inspection of a breeder’s facilities, all of which have been completed by a manager, employee or agent acting on behalf of PawPointer. To the extent necessary, PawPointer has also completed a telephonic reference check, based upon: information provided directly by the breeder; a veterinarian office utilized by the breeder; and telephonic reference checks, based upon information provided by the breeder, identifying its current and previous dog buyers. The Company has also verified readily available online information about the breeder and, to the extent necessary, breeder references through various online searches. Breeders with unsatisfactory evaluations have, to the greatest extent possible, been prohibited from being featured or otherwise endorsed by us. While PawPointer makes every attempt to present accurate and reliable information on our website, the Company does not guarantee the accuracy, completeness, efficacy, timeliness, or correct sequencing of any or all of such information. PawPointer also highly recommends that any person considering the use of any recommended breeder, make its own independent investigation of the breeder chosen.

In view of the foregoing, PawPointer expressly disclaims all warranties of any kind, express, implied, statutory or otherwise, including, but not limited to, implied warranties or merchantability, fitness for a particular purpose, title and non-infringement, with regard to the site, the service, the content, and any product or services furnished or to be furnished via the site or through contacts made through the site. PawPointer does not warrant that any functions performed or provided by the site or the service will be uninterrupted, timely, secure or error-free, or that any defects in the site or the service will be corrected. PawPointer further does not warrant the accuracy or completeness of the content, or that any errors in the content will be corrected. You understand and agree that you are personally responsible for your behavior in using the site. You agree to indemnify, defend and hold harmless PawPointer, its affiliates, employees, agents and any third party providers to the site of service or content, from and against: all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting or arising from your use, misuse, or inability to use the site, the service or content; any violation of the Terms of Use; or any breach by you or anyone acting on your behalf of any representations or warranties you may have provided the Company.

You agree that any cause of action, controversy or claim arising out of or related to the use of this site, service or content between PawPointer and you, or as to the construction, interpretation and effect of this agreement, shall be settled by binding arbitration. In this regard, you agree to submit to jurisdiction for such arbitration within the State of Nevada and further agree that the arbitration laws of said state shall be applicable to any such proceeding. You agree that PawPointer has the exclusive right to select a singular arbitrator, having no prior affiliation to the Company, to conduct such arbitration.
